1. About Us

Shay's Driving School & Training Centre ("Shay's", "we", "us", "our") is a South African driving school. You can reach us at hello@shaysdrivingschool.com, on +27 71 091 2884, or at 136 Green Oak Street, New Horizons, Plettenberg Bay, 6600.

2. Eligibility & Guardian Consent

By registering you confirm you are legally competent to contract with us. If you are under 18 a parent or legal guardian must give consent, contract on your behalf and accept these terms. Learners must meet the legal requirements for the relevant licence.

3. Accurate Account Information

You agree to provide true, accurate and current information when creating your account and to keep your details up to date. We may suspend or cancel access where information is materially inaccurate or misleading.

4. Bookings, Availability & Confirmation

A booking is only confirmed once payment (or accepted proof of payment, where applicable) has been verified and we have issued a confirmation. Lesson dates and times are subject to instructor, vehicle and venue availability. We may reasonably reschedule where necessary and will offer an alternative slot.

5. Prices & Payment

All prices are in South African Rand (ZAR) and are payable in advance. Online card payments are processed securely by PayFast. We do not receive or store your full card details. EFT payments are processed via our verified bank account and require valid proof of payment.

6. Packages & Special Deals

Packages, promotional bundles and special deals are subject to their own conditions (such as bonus lessons or discounted rates). Promotional benefits are non-transferable and cannot be exchanged for cash.

7. Cancellations & Refunds

Cancellation and refund rights are set out in our Cancellation Policy and Refund Policy, which form part of these terms.

8. Customer Safety & Conduct

You must attend lessons sober, wear a seatbelt, follow the instructor's reasonable directions and obey all road laws. You may not drive under the influence of alcohol, drugs or medication that impairs driving. We may end a lesson immediately, without refund for that lesson, where conduct is unsafe, abusive, discriminatory or unlawful.

9. Lawful Use of Website & Portal

You may use our website and student portal only for lawful purposes. You may not attempt to gain unauthorised access, interfere with the service, upload malicious code, harvest data, or use the portal to impersonate another person.

10. Communications & Marketing Opt-out

You agree to receive operational communications (booking, payment, reminder and administrative messages) via email, SMS and WhatsApp. Where we send optional marketing communications you may opt out at any time by contacting us at hello@shaysdrivingschool.com or by using the unsubscribe link where provided.

11. Privacy (POPIA)

We process personal information in accordance with the Protection of Personal Information Act, 2013 (POPIA) as described in our Privacy Policy.

12. Service Interruption & Force Majeure

We are not liable for delay or failure to perform where caused by events beyond our reasonable control, including load-shedding, extreme weather, vehicle breakdown, illness, road closures, civil unrest, strike action or a network/hosting outage. We will reschedule or credit lessons affected on our side as set out in the Cancellation Policy.

13. Complaints

We take complaints seriously. Please email hello@shaysdrivingschool.com with the details and we will respond as soon as reasonably possible.

14. Governing Law & Severability

These terms are governed by the laws of the Republic of South Africa. If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.

15. Consumer Protection Act

Nothing in these terms limits or excludes any right you have under the Consumer Protection Act, 2008 or any other law that may not lawfully be excluded.
